There shall be a separate fund of the Board. It consists of the following amounts:
• Amounts received from the Government of Nepal,
• Amounts received in the form of loan, grant or assistance from any foreign government or international organization or body,
• Amounts received in consideration for providing the service system to the ser vice providers,
• Amounts received as licensee fees from the service providers,
• Amounts paid as tariff by the customers,
All the expenses of the Board shall be borne out of the fund as Amounts received from any other source. The amounts credited into be the fund of the Board shall be deposited in an account to opened with any bank or financial institution with Nepal, and the operation of such an account shall be as prescribed.
User protection fund:
The Board shall establish a user protection fund, into which the amount received as fine by the Board shall be credited.
Accounts and audit:
The accounts of the Board shall be maintained in accordance w ith the prevailing laws. The Board shall carry out, or cause to be carried out, internal audit and internal control as prescribed. The audit of the accounts of the Board shall be carried out by the auditor appointed by the Committee. The Government of Nepal may, if it so wishes, examine, or cause to be examined, the accounts of the Board and docum ents relating thereto, at any time.
Appointment of Executive Director (ED):
• The Committee shall appoint person who has qualification as prescribed to the office of ED to act as the administrative chief of the Board.
• The term of office of the ED shall be Five years.
• If the ED fails to discharge his or her official duties, does any act contrary to the interests of the Board or suffers any bad conduct or fails to act in consonance with the direction given by the Committee, the Committee may, at any time, remove him or her from the office of ED in accordance with the prescribed procedures.
• Prior to so removing him or her from the office, the ED shall not be deprived of a reasonable opportunity to defend him self or herself.
• The remuneration, facilities and other terms and conditions of service of the ED shall be as prescribed.
Functions, duties and powers of the Executive Director:
The functions, duties and powers of the ED shall be as follows:
(a) To implement the decisions and directions of the Committee,
(b) Prepare long-term and short-term programme,
(c) Implement program approved by the Committee,
(d) Submit proposals to the committee, that has to be approved by the committee,
(e) To carry out such other functions as prescribed.
Offences and Punishment:
If a person commits the following offence by doing any act in contravention of the Act or the Rules framed under this Act, the Board may punish such person as follows:
• In the case of demolish ing, disordering, or other ise causing loss or damage to, any structure, installation of the offence, along w ith recovery of the loss and to Fifty Thousand Rupees in view of the magn itude or in frastructure relatin g to the service, a fine of up damage so caused,
• degree of the offence, upto Twenty Five Thousand Rupees in view of the health by contaminatin g the potable water, a fine of In the case of causing adverse effect to the public
• In the case of un-authoritatively using or misusing the service, a fine of up to Fifteen Thousand Rupees in view of the magn itude of the offence,
• In the case of disordering the service measuring equipment or similar other equipment or causing obstruction to the provis ion of the service, a fine of up to Ten Thousand Rupees in view of the magnitude of the offence,
• In the case of stealing, disordering, demolishing or destroying the pipeline installed to the service, a fine equal to the amount in question of the loss caused from such act, along with the recovery of such amount from that person, and if the offender is a user, stoppage or suspension of the service to such a user for up to Six months.
• Power to borrow loan and obtain assistance: The Board may borrow loan or obtain assistance from any bank or financial institution with in Nepal or any foreign government, international organization or body. Prior to borrowing a loan or obtaining assistance from a foreign government, international organization or body, the Board shall obtain permission of the Government of Nepal.
• Power to make investment: The Board may make investment of money in the fund taking into consideration of the interests of users.
• Power to enter into house and land: The employee may enter into house and land of user by giving information there of, accompanied by the reason, to the concerned person. Provided that, if there is any reasonable ground and reason to doubt that any person is misusing the service or using the service in an unauthorized manner, it is not required to give information.
• Power to lay pipes in public or private building and land: The Board may lay pipelines or make other structures in any public or private building and land for the purpose of provide the water supply or sanitation service to the users. If, in laying the pipelines or making other structures, any loss or damage is caused to the private building and land of give a reasonable compensation to the concerned building and land owner in consideration for such loss or damage as per prevailing laws
• Power to collect fees from service providers: The Board may collect fees as prescribed from the service providers operating the service within its geographical area.
• Power to suspend or terminate service: The Board or service provider, as the case may be, may suspend or terminate the service of any user who defaults on payment of the tariff fixed.
• Power to form sub-committee: The Board may form subcommittees, as required, comprising also of concerned experts related with various fields, service provider and users for the smooth operation of the activit ies to be operated by it.
The functions, duties and powers of the sub-committees formed and the facilities to be received by the members of the sub-committees shall be as prescribed.
• Power to frame Rules: The Board may frame necessary Rules, and such rules shall come into force after being approval by the Government of Nepal.
• Power to frame and enforce directives: The Board may frame and enforce necessary directives.
If the service system operated and managed by the Nepal Water Supply Corporation is transferred to the Board, the Board shall have the right over all sources of the water used by the Corporation for the provision of the service. In relation to the laying of pipes in any public or personal land and house in the course of using, operating and repairing or maintaining or rehabilitating the service system transferred from the Corporation, relation to the reconstructing or rehabilitating of the structures, the Board shall have the same powers as the Corporation has.
Functions, duties and powers of the Board:
• To acquire, build, expand, reform and rehabilitate the service system,
• To formulate and implement policies on the use of the service,
• To prevent the misuse of potable water and prevent pollution of potable water
• To carry out study, research and survey on the source, distribution of potable water, and sanitation,
• To formulate and implement short-term and long-term policies on the service system
• To ascertain such in vestment as required for the operation of the service and prepare a plan for the same, and arrange financial resources,
• To have the rate of tariff service fixed pursuant to the pre vailing laws,
• To make necessary arrangements for the provision of qualitative and effective ser vice, of the development of the service and acquire the same, To identify the source of funding required for the expansion and
• To give license to the service providers for provid ing the service, or provide the service by entering into an agreement with the service providers,
• To recover the fixed tariff in consideration for the service provided to the users,
• If any user is aggrieved while providing the service by the service pro vider, to hear the grievance and provide appropriate remedy
• To perform such other functions as prescribed as may be required for the operation of the service.
